Overview
Moldova occupies an intermediate position: alongside the CIS conventions, a 1993 bilateral treaty on legal assistance in civil, family and criminal matters applies between the two states. At the same time Moldova belongs to the Council of Europe and has held EU candidate status since 2022.
In practice that means a dual standard of review. A formal channel to Russia exists, but extradition cases receive full judicial review under the ECHR, and politically motivated prosecution is examined on the merits. In recent years practice has shifted markedly towards refusals.
Moldova does not surrender its own nationals. A separate risk factor is the Transnistrian section: control there is organised differently and legal safeguards operate only to a limited extent.
