Overview
Vietnam is perceived as a 'neutral' destination, but not from a wanted-alert perspective: a treaty on legal assistance in civil and criminal matters, signed in 1998 and in force since 2012, applies between the two countries. It expressly governs surrender, both for prosecution and for the enforcement of sentences. Inter-agency ties are traditionally close.
The surrender procedure is barely formalised in terms of public scrutiny: timelines, grounds and the course of proceedings are opaque, access to the file is limited and effective appeal mechanisms are few.
An additional risk is migratory: a notice-based detention can lead to visa cancellation and removal, which in effect resembles surrender but takes place outside the extradition procedure.
